Website use
Use this website lawfully and do not attempt unauthorized access, interference, scraping, abuse, security testing without authorization or misuse of any Qsura system or content.
Acceptable communication
Subscribers must not transmit unlawful, threatening, abusive, defamatory, privacy-invasive, obscene, misleading or unauthorized promotional content through Qsura services.
Channel rules and approvals
SMS, RCS and WhatsApp usage may be subject to additional requirements for message content, delivery, consent, opt-in, opt-out, approved templates, sender readiness and regulatory compliance.
Service scope and commercial terms
Product capabilities, pricing, onboarding, support and commercial terms are confirmed in the applicable proposal, order, plan or agreement before activation.
Meta WhatsApp Business API Terms
Opt-in Requirement
Customer must obtain valid and verifiable user consent before sending WhatsApp messages.
No purchased, scraped, rented, or third-party contact databases may be used.

- Suspend messaging
- Disable WABA
if quality ratings decline or policies are violated.
Qsura is not responsible for such actions.
Commerce Policy
Businesses may not promote prohibited products including, but not limited to:
- Drugs
- Weapons
- Gambling
- Adult services
- Counterfeit goods
- Illegal products
- Tobacco where prohibited
- Unsafe financial schemes
Business Verification
Meta may require:- Business Verification
- Domain Verification
- Display Name Review
Blue Tick Verification
Qsura cannot guarantee approval for Meta Verified or Official Business Account (green/blue verification) status. Approval is determined exclusively by Meta.
Account Suspension
Meta may:- Suspend templates
- Restrict messaging
- Disable phone numbers
- Suspend WhatsApp Business Accounts
Qsura shall not be liable for such actions.
Data Processing
Customer authorizes Qsura to process message data solely for delivering services in accordance with applicable privacy laws.
Advertisement Destination Compliance Where advertisements include a "Send WhatsApp Message" button or otherwise direct users to WhatsApp, the Customer shall ensure that:- Advertisements accurately represent the promoted product or service.
- Landing pages (if any) match the advertisement.
- WhatsApp conversations continue the advertised experience.
- Users are not misled regarding pricing, availability, offers, or services.
- Promotions comply with all applicable laws and Meta policies.
Qsura India Pvt. Ltd. has no control over Meta's automated or manual review processes.
Meta may suspend, restrict, reject, or permanently disable any Meta Business Account, Advertising Account, Facebook Page, Instagram Account, WhatsApp Business Account, Phone Number, or related asset without prior notice.

The Customer is solely responsible for ensuring that:

- Products and services promoted are permitted under Meta policies.
- Customer data is collected and used lawfully.
- Appropriate user consent has been obtained before initiating business messaging.
Google RCS Business Messaging Terms
Brand Verification Business name must accurately reflect the legal entity. False or misleading branding is prohibited. User Consent Businesses must obtain appropriate consent before sending promotional or marketing RCS messages. Opt-Out Every marketing campaign should provide a simple mechanism to stop future messages (for example, replying "STOP"), where applicable and supported. Businesses must promptly honor opt-out requests.

- Proper grammar and spelling
- High-quality media
- Functional URLs
- Genuine branding
Google, telecom operators, or RCS partners may suspend an agent for policy violations. Qsura cannot reverse such enforcement decisions.
SMS Services Terms & Conditions
1. Compliance with TRAI Regulations
The Customer agrees to comply with all applicable laws, regulations, and guidelines issued by the Telecom Regulatory Authority of India (TRAI), including the Telecom Commercial Communications Customer Preference Regulations (TCCCPR), 2018, and any amendments, directives, or instructions issued by telecom operators, DLT platforms, or regulatory authorities.
The Customer shall ensure that all SMS campaigns are lawful, accurate, and compliant with applicable regulations.
2. DLT Registration
The Customer is solely responsible for:
- Registering as a Principal Entity (PE) on an approved DLT platform.
- Registering and maintaining valid Sender IDs (Headers).
- Registering Message Templates.
- Registering Consent Templates where applicable.
- Maintaining accurate business information on the DLT platform.
3. Customer Consent (Opt-In)
The Customer shall obtain valid, explicit, and verifiable consent from recipients before sending promotional or consent-based SMS messages.
The Customer shall maintain records of such consent and provide evidence if requested by Qsura, telecom operators, regulatory authorities, or other competent authorities.
The use of purchased, rented, scraped, harvested, or otherwise unauthorized contact databases is strictly prohibited.
4. Opt-Out Compliance
The Customer shall promptly honor unsubscribe, opt-out, or consent withdrawal requests received from recipients.
The Customer shall immediately cease sending promotional messages to recipients who have opted out or withdrawn consent.
5. Message Content
The Customer shall ensure that all SMS content:
- Is truthful and not misleading.
- Accurately represents the promoted product or service.
- Does not contain false, deceptive, fraudulent, or exaggerated claims.
- Does not infringe any intellectual property rights.
- Complies with all applicable laws and TRAI regulations.
The Customer shall not use the SMS platform to transmit messages relating to:
- Illegal products or services
- Gambling or betting where prohibited
- Fraudulent investment schemes
- Pyramid or Ponzi schemes
- Phishing or identity theft
- Malware or malicious software
- Obscene or sexually explicit content
- Hate speech or discriminatory content
- Violence or terrorism
- Counterfeit goods
- Unauthorized financial services
- Misleading healthcare or pharmaceutical claims
- Tobacco, narcotics, or prohibited substances
- Any content prohibited under applicable laws or telecom operator policies
Qsura reserves the right to reject or suspend any campaign containing prohibited or non-compliant content.
7. Template Matching
The Customer acknowledges that telecom operators validate SMS content against the approved DLT Message Template.
The Customer shall ensure that the submitted message matches the approved template. Messages that do not conform may be rejected or blocked by telecom operators.
Qsura shall not be responsible for template mismatches or operator rejections.
8. Sender ID (Header)
The Customer shall use only approved Sender IDs registered under its own Principal Entity on the DLT platform.
The Customer shall not impersonate another organization or use unauthorized Sender IDs.
9. Delivery of Messages
SMS delivery depends on factors beyond Qsura's control, including:
- Telecom operator filtering
- Network congestion
- Device availability
- DND preferences
- Recipient handset status
- Government directives
- Force majeure events
Qsura does not guarantee delivery of every SMS.
10. DND Compliance
The Customer acknowledges that promotional SMS messages may not be delivered to recipients who have registered their numbers under the National Customer Preference Register (NCPR) or other applicable Do Not Disturb (DND) preferences, except where permitted by law or valid consent.
The Customer shall not attempt to circumvent DND regulations.
11. Misuse of Services
The Customer shall not:
- Send spam or unsolicited SMS.
- Generate artificial traffic.
- Send repetitive or excessive messages.
- Use misleading sender identities.
- Use automated systems for unlawful messaging.
- Misrepresent products or services.
- Attempt to bypass telecom operator filtering or regulatory controls.
Qsura reserves the right to suspend, reject, delay, or terminate any SMS campaign or account if:
- TRAI regulations are violated.
- Telecom operators reject the campaign.
- DLT requirements are not fulfilled.
- Spam complaints exceed acceptable thresholds.
- Fraudulent activity is detected.
- Regulatory authorities issue directions.
- Required documentation is not provided.
- There is suspected misuse of the platform.
13. Customer Responsibility
The Customer is solely responsible for:
- Recipient data accuracy.
- Maintaining lawful consent records.
- Content legality.
- Compliance with TRAI, DLT, telecom operator policies, and applicable laws.
- Any penalties arising from non-compliance.
14. Indemnification
The Customer agrees to indemnify and hold harmless Qsura India Pvt. Ltd., its directors, employees, affiliates, and partners from any claims, losses, penalties, regulatory actions, fines, damages, or expenses arising out of:
- Violation of TRAI regulations.
- Failure to obtain valid recipient consent.
- Spam complaints.
- Unauthorized messaging.
- Illegal or misleading content.
- Intellectual property infringement.
- Misuse of the SMS platform.
- Breach of applicable laws or telecom operator requirements.
The Customer acknowledges that TRAI regulations, telecom operator policies, DLT requirements, and technical specifications may change from time to time.
Qsura may modify its SMS services, platform functionality, technical requirements, or these Terms & Conditions as necessary to comply with such changes. Continued use of the SMS services after such modifications constitutes acceptance of the updated requirements.
Third-party dependencies
Telecom networks, platform providers, payment providers and regulators may affect availability, approvals, route behavior, campaign timing and delivery outcomes.
Suspension and enforcement
Unauthorized use of the website or services may lead to suspension, termination, claims for damages or legal consequences where applicable.
Disputes
Disputes are subject to applicable Indian law, the applicable commercial agreement and relevant regulatory authorities or forums.
